(5) The exchange of notes concerning the Cooperation in Space Explortation between Japan and ESRO(Entered into Force December 12,1972)

Sir,

Under instructions from my Government, I have the honor to propose the following arrangement concerning cooperation on space research and development for peaceful purposes between the Government of Japan (the Science and Technology Agency will act as the executing agency) and the European Space Research Organisation:

1.

The Government of Japan on the one hand, and the European Space Research Organisation on the other, will periodically exchange scientific and technical information published by them without restriction as to use. This information includes the following publications:

Scientific memoranda, notes and reports,

Technical memoranda, notes and reports,

Special publications,

Other general reports.


2.

The Government of Japan and the European Space Research Organisation will endeavour to exchange information on space programmes and projects of mutual interest with the aim of studying their possible coordination.
If, after such an exchange of information, coordination or joint participation in the execution of those programmes and projects is found to be desirable and feasible, a special agreement to this end will be concluded in each specific case.


3.

The Government of Japan and the European Space Research Organisation agree in principle to arrange the exchange of visits of specialists aiming at mutual familiarisation with scientific work in progress. The implementation of such arrangements, including the determination of dates and length of visits, will be agreed on between the Parties.


4.

The Government of Japan and the European Space Research Organisation agree to hold meetings of their officials as required, in order to discuss general matters of interest to the Parties, particularly general policy problems and such other problems as concern the fields where closer cooperation of the Parties is desired.


5.

No exchange of funds between the Parties is foreseen under this agreement. In particular, each Party bears the cost of transfer of the information referred to under item 1 and the cost of the visits of its own specialists and officials, as foreseen under items 3 and 4. However, in the case referred to under item 2, special financial provisions may be considered according to the circumstances.

If you are in agreement with the foregoing terms and conditions, I should appreciate receiving your reply in the affirmative on behalf of the European Space Research Organisation. This, together with my letter, would then constitute the Agreement between the Government of Japan and the European Space Research Organisation on the items of cooperation set out in those letters.

I propose that the date of entry into force of the agreement should be that of your letter in reply.
