Duties

7. (1)

Each request by the company for a proposal for the construction of a satellite or earth station shall be submitted to the Minister and no such request shall be issued, within thirty days after the submission thereof to the Minister, to a person qualified to submit a proposal in response thereto unless the Minister indicates in writing to the company, within that time, that the Minister is satisfied that the request, by its terms, will result in proposals that specify a reasonable utilization of Canadian design and engineering skills and the incorporation of an appropriate proportion of Canadian components and materials.

(2)

No proposal submitted to the company in response to a request for a proposal for the construction of a satellite or earth station shall be accepted by the company within thirty days after the proposal is submitted to it unless

(a)

the proposal is submitted in response to a request for a proposal in respect of which the Minister has indicated satisfaction pursuant to subsection (1) and that conforms to the terms of the request; or

(b)

the Minister indicates in writing to the company, within the thirty day period, that the Minister is satisfied that the proposal specifies a reasonable utilization of Canadian design and engineering skills and the incorporation of an appropriate proportion of Canadian components and materials.

(3)

No contract for the construction of a satellite or earth station is of any force or effect unless the provisions of subsections (1) and (2) with respect to the request for a proposal and the proposal resulting in the contract have been complied with. R.S., c. T-4, s. 8.
