(3) DECLARATION BY CERTAIN EUROPEAN GOVERNMENTS RELATING TO THE ARIANE LAUNCHER PRODUCTION PHASE(Entered into Force April 14,1980)

parties to the Arrangement between certain European Governments and the European Space Research Organization concerning the execution of the Ariane launcher programme, and the Governments of ..............

(hereinafter referred to as "the Participants"),

HAVING REGARD to the Arrangement signed on 21 September 1973 between certain European Governments and the European Space Research Organization concerning the execution of the Ariane launcher programme, and in particular Articles I, III.1 and V thereof which provide for a new Arrangement defining the production phase of the Ariane programme.

HAVING REGARD to the Convention for the Establishment of a European Space Agency, opened for signature on 30 May 1975, (hereinafter referred to as "the Convention"),

HAVING REGARD to the Resolutions of the Council of the Agency ESA/C/XXIV/Res 3 and ESA/C/XXX/Res. 7, authorising the Agency to undertake an initial production phase comprising six Ariane launchers,

HAVING REGARD to the French Delegation's proposal concerning the Ariane launcher production (documents ESA/C/(79)93, ESA/C/(79)127 + add. 1) and to the discussions on the said proposal during the 33rd, 34th and 36th meetings of the Council,

HAVING REGARD to Council Resolution ESA/C/XXXIII/Res. 3 adopted on 26 July 1979 and amended during the meeting of the Council held on 11 September 1979, concerning the production of Ariane launchers,

HAVING REGARD to the Agreement between the Government of the French Republic and the European Space Agency on the use of the French Guiana Space Centre signed on 5 May 1976 (hereinafter referred to as "the CSG Agreements"),
